Flight Canceled or Delayed: Know Your Air Passenger Rights

Traveling by air can be both exciting and stressful, and one thing you should always be aware of as a passenger is your rights. These rights can vary significantly depending on where you’re flying from or to. In this blog post, we’ll explore air passenger rights in Brazil, Europe, and the United States to help you better understand what to expect in different situations.

Brazilian Air Passenger Rights

In Brazil, the National Civil Aviation Agency (ANAC) is the regulatory authority that oversees all matters related to flights. When it comes to air passenger rights, the key legislation you should be familiar with is ANAC Resolution No. 400.

ANAC Resolution No. 400 clearly outlines the responsibilities of airlines when flight-related issues occur. It also covers various passenger rights, specifying the types of assistance that airlines are obligated to provide in each situation.

When Does Consumer Protection Apply in Brazil?

  • Domestic flights within Brazil
  • International flights departing from a Brazilian airport
  • International flights arriving at a Brazilian airport
  • Connecting flights at a Brazilian airport
  • Any airline ticket issued in Brazil (even if the flight is operated abroad)

Your Rights in Brazil

  1. Information: In the event of a flight delay at the airport, the airline must promptly inform you of the cause of the delay and the new estimated departure time. They should also provide updates every 30 minutes.
  2. Right to Assistance: Whenever flights are delayed or canceled, the airline must provide material assistance to passengers. The type of assistance depends on the length of the delay after your original departure time:
    • From 1 hour: communication (internet, phone)
    • From 2 hours: food (voucher, meal, snack)
    • From 4 hours: accommodation in case of an overnight stay at the airport and round-trip transportation. If you are in your hometown, the airline may only offer transportation to your residence and back to the airport.
  3. Right to Refund or Re-accommodation: According to ANAC rules for flight cancellations or delays exceeding 4 hours, airlines must offer the following options to passengers:
    • Full ticket refund, including the airport tax OR
    • Re-accommodation on another flight operated by the same airline OR
    • Re-accommodation on a flight operated by another airline if there is no availability with the airline you purchased the ticket from OR
    • Rescheduling the flight for a new date and time at no cost
  4. Rights in Overbooking Situations: If your flight is overbooked, the airline will ask passengers to volunteer to give up their seats. Volunteering passengers may receive compensation, but the amount can be negotiated individually between the passenger and the airline. If no one volunteers, the airline can deny boarding to some passengers.
    • Domestic flights: R$1,300
    • International flights: R$2,600


European Air Passenger Rights

In the European Union (EU) and associated territories like the UK, Iceland, Norway, and Switzerland, air passenger rights are governed by Regulation (EC) No. 261. This comprehensive legislation, adopted in 2004, applies to all passengers departing from or arriving at airports within these areas.

Key Rights in Europe

Right to Information: Airlines must provide information to passengers at check-in counters in all airports where they operate.

Right to Assistance: Passengers have the right to free material assistance from the airline in the event of flight disruptions. While awaiting a solution, the airline should provide:

  • Drinks and meals
  • Two communications (phone, fax, or email)
  • Accommodation if the alternative flight is not on the same day
  • Transportation to and from the airport and the accommodation location

If the airline does not offer this assistance, keep all receipts for additional expenses, as you may be eligible for reimbursement.

Compensation:

Compensation for delayed flights: Any delay exceeding three hours entitles passengers to compensation. The amount depends on the delay time and flight distance.

  • Less than 3 hours: No compensation
  • 3 to 4 hours: €250 to €400 depending on the flight distance
  • Over 4 hours: €250 to €600 depending on the flight distance
  • Never reached the destination: €250 to €600 depending on the flight distance

Compensation for canceled flights: If the airline notifies you of a flight cancellation less than 14 days before the scheduled departure, you may be entitled to compensation based on the distance and waiting time.

The statute of limitations for claiming compensation varies from 1 to 10 years, depending on the European country, so be sure to check your specific case.



U.S. Air Passenger Rights

Air travelers have certain rights in the United States, but they differ from those in Brazil and Europe. While U.S. airlines are required to compensate passengers for overbooking situations, there are no mandatory regulations for passengers affected by long delays or cancellations.

Overbooking Compensation in the U.S.: If you’re denied boarding due to overbooking in the U.S., you could be entitled to up to $1,350 in compensation.

Tips for Dealing with Air Travel Issues Worldwide

No matter where you’re flying, here are some valuable tips for dealing with air travel disruptions:

  • Don’t wait for the airline to come to you; seek assistance proactively.
  • Take immediate action to resolve the issue and then seek reimbursement.
  • Avoid checking baggage whenever possible, as canceled flights usually hold your checked luggage until a new flight is allocated to you.
  • File a complaint immediately, preferably in writing, and attach all documentation. Take photos of airport boards and keep any evidence that can help support your case. Record conversations with airline staff if necessary.
  • Consider purchasing travel insurance, especially when traveling to non-EU countries, as almost all of them offer reimbursement or composition in case of delayed and canceled flights.
  • Review the coverage and conditions of your credit card’s travel insurance.

Une nouvelle initiative européenne pro-science mérite le support public

Une nouvelle initiative citoyenne de l’UE organisée par des étudiants exige un processus d’autorisation scientifique rationalisée dans le domaine de l’agriculture. Ils méritent d’être entendus et soutenus.

Le 25 juillet, la Commission européenne a enregistré l’initiative citoyenne “Grow Scientific Progress : Crops Matter !” (“grandir l’innovation scientifique: les cultures sont importantes”). Deux étudiantes sont nommées comme représentantes, à savoir Martina Helmlinger et Lavinia Scudiero. Helmlinger est sur le point de terminer sa maîtrise en “sécurité de la chaîne alimentaire” à l’Institut des sciences et technologies alimentaires de l’Université des ressources naturelles et des sciences de la vie de Vienne, et possède une licence en biotechnologie. Scudiero est diplômée en médecine vétérinaire, elle s’intéresse à la sécurité alimentaire, et elle poursuit actuellement une maîtrise en sécurité alimentaire, le droit alimentaire et affaires réglementaires à l’Université de Wageningen.

Dans l’argumentaire de l’initiative, les deux étudiants soutiennent que la directive 2001/18/CE de l’UE est dépassée, et suggèrent un mécanisme automatique pour la réviser. L’objectif est de rationaliser la procédure d’autorisation de mise sur le marché, désormais longue et coûteuse, et de permettre davantage de progrès scientifiques dans l’UE. Les évaluations individuelles, par opposition aux définitions générales, aident à permettre l’arrivée de nouvelles technologies sur le marché.

Comme l’explique Marcel Kuntz, directeur de recherche au CNRS (Centre national de la recherche scientifique) à Grenoble : “L’agro-biotechnologie n’est pas un mode de production agricole, c’est un moyen d’accroître la biodiversité. Ce qui est important, c’est ce qu’on fait d’un produit, pas comment on l’a obtenu.” Kuntz se plaint aussi des attaques contre les scientifiques et que la sûreté des innovations scientifiques est définie à travers un débat politique.

Le débat sur l’innovation en agriculture a été pris en otage par des communicateurs professionnels qui ont tout fait pour calomnier l’innovation technologique. C’est un phénomène médiatique problématique — pour chaque innovation on nous parle longuement des risques potentiels (souvent imaginaires), en oubliant les opportunités énormes.

Cela affecte même les outils de communication des institutions de l’UE, visible dans le débat des OGM. Sur le site web “Legislative Train Schedule” (“calendrier du train législatif”) du Parlement européen, les rapporteurs des directives sont censés expliquer de manière neutre la ligne d’action législative. C’est un outil qui transmet l’information aux citoyens de façon non partisane.

Frédérique Ries, membre belge du Parlement européen, n’a pas pris ce travail très au sérieux. Dans un article sur le site résumant la directive (UE) 2015/412, elle écrit :

“Le Parlement européen a également insisté pour que les États membres, dans lesquels des cultures GM sont cultivées, évitent la contamination transfrontalière en établissant des zones tampons le long de leurs frontières avec les États membres voisins dans lesquels les OGM ne sont pas cultivés.”

La vérité est que des organisations comme Greenpeace mentent sur les OGM depuis des décennies. Ils expliquent que les OGM représentent des “risques inacceptables”, sans mettre en évidence des preuves scientifiques soulignant ce risque. Ils écrivent par exemple:

“Les cultures génétiquement modifiées n’ont pas leur place dans l’agriculture durable. Ils comportent des risques inacceptables créés par le processus de génie génétique.”

Les mêmes ONG qui se sont assurées que l’UE n’utiliserait pas de cultures génétiquement modifiées ont également célébré une affaire devant la Cour de justice de l’Union européenne, dans laquelle il est dit que le génie génétique devrait être traité de la même manière que les OGM. Greenpeace décrit le génie génétique comme “OGM par la porte de derrière”.

Le chef de l’Autorité européenne de sécurité des aliments (EFSA), Dr. Bernhard Url, explique qu’il ne faut pas “tirer sur la science” si on n’aime pas les résultats en question. Il ajoute que “si la science ne devient qu’une opinion de plus, qui peut être négligée en faveur de la superstition, cela comporte un risque énorme pour la société”.

Il a raison. Le génie génétique offre déjà de nombreux avantages à l’amélioration génétique, par exemple en créant des aliments sans allergènes. Imaginez l’immense changement pour les personnes atteintes d’allergies potentiellement mortelles, si nous parvenons à créer des arachides sans allergènes ou du blé sans gluten. Cependant, ces applications dépassent le domaine de l’agriculture. Le génie génétique peut aider à combattre le virus Zika, à prévenir la transmission du paludisme, à guérir la leucémie et montre des recherches prometteuses dans les domaines de la maladie d’Alzheimer, de la maladie de Huntington, du cancer du col utérin et du cancer du poumon.

Le génie génétique risque d’être victime de la même peur non scientifique que les OGM. D’autres continents innovent alors que l’Europe s’enfonce dans un fossé technologique. 

L’initiative Grow Scientific Progress peut aider à aller à l’encontre de cette évolution. L’Union européenne doit s’ouvrir à l’innovation scientifique afin de saisir les opportunités passionnantes de demain.

Public security must be a priority in Europe’s 5G rollout

A national assessment of the risks associated with the next generation of communications infrastructure is the first step toward an EU-wide cyber-security strategy.

The European Commission’s incoming president, Ursula von Der Leyen, will have a series of politically delicate hurdles to contend with in the field of cyber security when she assumes office on 1 November 2019.

Not least is the domain of 5G communications, where the EU has come under increased pressure from its American counterparts to adopt a hostile position against next-generation technologies emanating from Asia-based companies.

Following a Commission recommendation for a common EU approach to the security of 5G networks, member states have recently submitted national risk assessments that provide an overview of their most pressing concerns in the future development of 5G infrastructure. These will feed into the next phase, an EU-wide risk assessment to be completed by 1 October 2019, which the Commission says will be the first step toward implementing a real cyber-security strategy across the EU.

Is this so important for ordinary users and consumers? It’s not so long ago that we heard the news about vendors from illiberal countries being involved in scandals such as the backdoors in Vodafone Italia’s fibre network provided by Huawei. As we move to a society where connected devices are part of daily life, from smart lights to smart home locks to connected cars, the privacy and security of the network will be central to everyday life.

According to research by analysts Berg Insight, there were a total of 22.5 million smart homes in Europe at the end of 2017. This number is predicted to grow to 84 million homes by the end of 2022, representing a market penetration of 35 per cent. Add to this an estimated 45 million smart homes in the United States at the end of 2017.

Consumers want to be able to rely on their network provider to keep what happens inside their smart buildings private and stored securely. For this reason, security must be a defining feature of the standards and norms that govern the global ICT supply chain, as well as the individual pieces of software and hardware that businesses and consumers depend on. Inaction risks undermining the ability of businesses and individuals to exercise meaningful choice in critical 5G and other ICT products and services.

Some of the EU’s largest member states, including Germany and Italy, have used the auctions of spectrum licenses as a cash cow for their national budgets instead of seeing newly utilised frequencies as a gamechanger for consumer connectivity. This has led to the undesired consequence that many operators are cash-strapped and tend to go for cheaper and less trustworthy infrastructure providers. The result is a toxic reliance on very few suppliers, some of whom are accused of operating with questionable motives.

If the next Commission wants to successfully secure the digital ecosystem, it has to coordinate technical standards for interoperability, such as the more trustworthy open-source solutions, and promote an environment based on transparency and trust to make sure national governments will implement liability rules for operators and resellers of software and devices that expose consumers to the risk of malicious and illegal interference. This is the only way to protect consumers, promote innovation and foster safe digital lives for consumers.
